6 MARINE
 
6.1 GENERAL
6.1.1 The Marine Department shall be responsible for all marine-related matters.
6.1.2 No guarantee, condition, warranty or representation is given by the Club for the suitability of any berth, structure, gear or other facilities provided.
6.1.3 The Club cannot accept responsibility for disturbance, noise, dust, or any other inconvenience suffered by Owners on account of building and/or maintenance work carried out at the Premises or on land adjoining thereto.
6.1.4 A Member shall not allow any other person to use his mooring, shed or open space without the permission of the General Manager. The General Manager may impose such terms and conditions as he or she sees fit for the use of the mooring, shed or open space.
6.1.5 A boat kept at the RSYC shall not take part in a race or competition under any Clubs' names other than that of the Republic of Singapore Yacht Club without written permission from the Club.
6.1.6 Distinguishing marks on boats and trailer
 
6.1.6.1 All boats, tenders and trailers shall be painted with the name of the Vessel and the Port of Singapore license number.
6.1.6.2 The RSYC Burgee is recommended to be displayed.
6.1.6.3 Every boat kept at the RSYC shall carry the words "Republic of Singapore Yacht Club" or the letters "R.S.Y.C." on the stern or such other part of the Vessel as is approved by the RSYC Committee.
   
6.1.7 The Club shall not be liable whether in contract, tort or otherwise, for any loss, theft, or any other damage of whatever nature caused to any Vessel or vehicle or other property of the Owner or others claiming through the Owner except to the extent that such loss, theft, or damage may be caused by the negligence or willful act of the Club or those for whom the Club is responsible.
6.1.8 The Owner shall indemnify the Club against all loss, damage, costs, claims or proceedings incurred by, or instituted against the Club or its employees or agents which may be caused by the Owner's Vessel or vehicle or by the Owner, his servants, agents, crew, guests or sub-contractors except to the extent that such loss, damage, costs, claims or proceedings may be caused by the negligence or willful act of the Club or those for whom it is responsible.
6.1.9 The Owner shall insure his Vessels and vehicles adequately against loss or damage howsoever caused and shall maintain third party insurance in respect of himself and each of his vehicles or Vessels, his crew for the time being, and his agents, visitors, guests and sub-contractors in a sum of not less than S$25,000 (Twenty-Five Thousand Singapore Dollars) in respect of each accident or damage and in respect of each Vessel adequate salvage insurance. Such insurance shall be effected and maintained at an insurance office of repute and the Owner shall produce the policy or policies to the Club on demand. Not withstanding that the minimum insurance cover is S$25,000, it is recommended that Members maintain insurance cover of at least S$ 50,000.
   
6.2 MARINA MANAGER / DOCKMASTER
6.2.1 The Marina Manager / Dockmaster shall be responsible for the day-to-day running of the Marine Department.
6.2.2 All Vessels and vehicles at the Club's Marina or Premises may be moved to any other part of the same Marina or Premises as directed by the Marina Manager / Dockmaster should the necessity arise.
   
6.3 BOAT REGISTER
6.3.1 All boats kept by Members at the Club must be registered with the RSYC in a boat register.
6.3.2 The register shall contain the following information:
 
6.3.2.1 name(s) of registered Owner(s) as per the Vessel's registration
6.3.2.2 telephone numbers of Owner in case of emergency;
6.3.2.3 name of boat;
6.3.2.4 copy of valid boat licence
6.3.2.5 copy of Vessel's registration
6.3.2.6 crew details if crew pass is required
6.3.2.7 engine type;
6.3.2.8 beam, draught and length overall (as measured by RSYC);
6.3.2.9 valid insurance certificate as per RSYC requirements 6.2.13.
   
6.3.3 The RSYC Committee shall have the discretion to register or to refuse to register a boat at the RSYC.
6.3.4 Boats not registered with the RSYC may use the Club's facilities only with the permission of the General Manager and on such terms and conditions set by the General Manager.
6.3.5 No boat shall compete in Club races unless registered with the RSYC and all current Membership subscriptions of the Member are fully paid.
   
6.4 WET BERTHS
6.4.1 Members shall seek advice from the Marina Manager / Dockmaster on the availability of berths before occupying any berth in the Marina and shall sign the Vessel arrival form and the berthing license agreement.
6.4.2 The berthing license is granted for leisure purposes only unless the Club has entered the boat's particulars in a separate boat register set up to record boats that are involved with non-pleasure boat activities and have complied with the Club's Non-Pleasure Craft Operator Regulations as determined by the RSYC Committee from time to time. The number of boats entered on this register is restricted and a waiting list will be maintained for Members who wish to engage in non-pleasure craft activities.
6.4.3 The RSYC Committee shall determine the monthly berthing charges payable by Members from time to time.
6.4.4 Multi-hulls will be charged at 1.5 times the scheduled rates.
6.4.5 Members shall leave a cabin entrance key and engine key(s) for the Vessel at the Marina office of the Club. (This is to enable the Vessel to be accessed in the event of an emergency, e.g. fire)
6.4.6 The Member shall ensure that their Vessel is moored in a safe, proper and seaman-like manner and shall ensure that no loose ropes are allowed to obstruct in any way the berths or pontoons and that all halyards, lines, ropes, rigging and sheets on their Vessels are secured so as not to create a nuisance to others.
6.4.7 Members shall provide adequate mooring lines and fenders and maintain them in good order.
6.4.8 Members shall not hang up or permit or suffer to be displayed clothing, linen or articles on or about any Vessel berthed at the Marina in such a manner as to be conspicuously visible to the other persons in the Marina.
6.4.9 Children entering the Marina must be accompanied by an adult who shall be responsible for their care and safety at all times.
6.4.10 Members with a licensed berth shall notify the Marina Manager should the Member intend to leave the berth vacant for an extended period.
6.4.11 Boats under power passing berths, slipways or the fuel jetty are to do so at speeds that will not create such a wake as to endanger other boats using the Marina facilities. The speed limit for each boat shall be such speed as does not create a wake or 5 knots, whichever is the lesser. Members shall be responsible for any damage caused by their wake and wash of their Vessels whether intentionally or unintentionally caused, or arising from their negligence.
6.4.12 A Vessel, when entering or leaving the Club's harbour, shall keep to the starboard side of fairways and/or entrances to fairways and keep clear of other boats.
6.4.13 A person shall not use a boat in the Marina in a dangerous or careless manner or without all reasonable consideration for other persons or boats in the vicinity.
6.4.14 No Vessel shall proceed under sail at the Club's Premises.
6.4.15 A person shall not without authority berth, anchor or beach any boat, or cause any boat to be berthed, anchor or beached, or leave any boat unattended in the Marina other than at a place set apart for such use.
6.4.16 No mooring or weighted object shall be placed anywhere in the Marina without prior permission from the Marina Manager / Dockmaster.
6.4.17 Swimming, fishing, diving and underwater activity is prohibited in the Marina without prior permission from the Marina Manager / Dockmaster
6.4.18 The placing of fishing traps, nets, etc., in the Marina is prohibited. If found they will be confiscated.
6.4.19 No oil, fuel, paint, chemical, pollutant, dangerous, inflammable, poisonous or obnoxious substance shall be discharged or deposited into the Marina or its vicinity.
6.4.20 Except in the case of Vessels having a re-circulating or holding tank lavatory system, lavatories aboard Vessels shall not be used whilst the Vessel is at the Premises. The Club provides lavatory facilities at the Clubhouse.
6.4.21 No boats shall be left tied up unattended at any time at the southerly side of the main wave attenuator without the express permission of the Marina manager.
6.4.22 No Member shall leave his boat unattended while it is in such a position as will prevent or obstruct the movement of any other boat.
6.4.23 No boat shall remain alongside the fuel jetty for any purpose other than fuelling. Once fuelling has been completed, boats shall remain alongside the fuel jetty no longer than 15 minutes.
6.4.24 The ramp is to be used only for the launching and retrieving of boats. Repairs, loading and washing down are not to be carried out on the ramp or its approaches.
6.4.25 Tenders to boats berthed in the Marina shall not be stored on the pontoons, fingers, ramps or walkways. Neither shall they be stored at the dry storage area unless written permission has been obtained from the Marina Office. All tenders stored at the storage area will be charged as per the scheduled rates.
6.4.26 Dock boxes and/or storage boxes shall not be used to store flammable liquids. The Owner shall not overload the box to such an extent that the box is damaged. The Owner is responsible for the condition of the box including damage incurred when entering or departing from the berth.
6.4.27 The Owner shall take particular care to ensure that his shore-power connection is properly wired and connected. It is strictly prohibited to alter and/or modify the electrical pedestal. The Owner shall be responsible for any damage caused to the electrical facilities due to poorly executed or negligent connections.
6.4.28 The Owner is to ensure that his water-hose is kept neatly coiled on the pontoon finger or in the dock box provided.
6.4.29 Rubbish is to be disposed of in the containers provided. Any waste oil is to be placed in a properly sealed container and taken directly to the allocated oil disposal area. Waste oil is not to be placed in the rubbish bins.
6.4.30 No fires for barbecues or otherwise are allowed without prior permission from the Marina Manager / Dockmaster and shall be carefully controlled at all times so as to ensure that they do not cause any nuisance or annoyance to any other users of the Marina or Premises or to any person residing in the vicinity.
6.4.31 No noisy, noxious or objectionable engines, radio, or other apparatus or machinery shall be operated within the Marina or Premises so as to cause any nuisance or annoyance to the Club, to any other users of the Marina or Premises or to any person residing in the vicinity and the Owner undertakes for himself, his guests and all using the Vessel that they shall not behave in such a way as to offend as aforesaid.
6.4.32 Pets must be kept on a leash at all times and Owners are responsible to clean up after their pets.
6.4.33 The Owner shall take all necessary precautions against the outbreak of fire in or upon his Vessel. The Owner shall provide on the Vessel at least the number of fire extinguishers as stipulated by the MPA boat license of an approved type and size fit for immediate use in case of fire. Owners shall not refuel Vessels in the Marina or anywhere on the Premises otherwise that at the Club's refueling facilities.
6.4.34 All persons who intend to live for more than 7 days aboard a boat moored at the RSYC must place their names in the RSYC registry of liveaboards. The RSYC reserves the right to disallow registration of any persons in this Registry.
   
6.5 VISITING VESSELS
6.5.1 Berthing charges for visiting yachts are payable in advance.
6.5.2 Visiting yacht captains must ensure that their crews obtain Crew Passes. The crew must keep this pass with them at all times.
6.5.3 Visiting yacht captains are responsible for the behaviour of their crew at all times.
6.5.4 All crew must be neatly and appropriately dressed when using the onshore facilities.
6.5.5 Nothing in the berthing agreement shall entitle a visiting yacht to the exclusive use of a particular berth.
   
6.6 DRY STORAGE OF BOATS OF LENGTH 8.5 METRES OR BELOW
6.6.1 Land storage is permitted provided storage space is available.
6.6.2 Application for storage of boats may be made by submitting an application form together with a copy of the MPA boat license and insurance policy to the Marine Department.
6.6.3 Upon acceptance of the application, a Member will be required to sign the RSYC's berthing license agreement. This license is granted for leisure purposes only unless otherwise authorised in writing by the Club.
6.6.4 Boat Owners are to provide suitably sized and well-balanced trailers in good and safe working condition for launching and recovery of their boats.
6.6.5 The RSYC Committee shall determine the monthly storage charges payable by Members from time to time.
6.6.6 The storage area will be determined solely at the discretion of the Club. Nothing in the berthing agreement shall entitle a Member to the exclusive use of a particular storage area.
6.6.7 All trailers shall be fitted with guide bars to assist with launch and recovery.
6.6.8 Boat Owners are to keep their boats for storage at the allocated areas only and are to keep the area tidy and clean.
6.6.9 Washing of boats or flushing of engines is not permitted in the boat sheds. Such works must be carried out in the allocated areas.
6.6.10 Members shall ensure that inflammable materials (other than the contents of the fuel tank) together with equipment or other items will be properly secured or removed. The RSYC shall not be liable for the loss of or damage to the Vessel or any item in the Vessel as a result of any inflammable materials, equipment or other item being left in the Vessel. The Member shall also ensure that the Vessel stored in the boat shed is equipped with a battery cut-off switch, which is easily accessed and clearly identifiable.
6.6.11 Members shall not alter or modify any adjacent structures or make any additions without the prior written approval of the RSYC Committee
6.6.12 Use of water and electrical facilities are provided in common with other Members and on an occasional and non-permanent basis only. Authorisation for the use of these services is to be obtained from the Marina Office prior to using these facilities.
6.6.13 Boat trailers may only be stored at the Premises by written arrangement with the Club and charged as per the scheduled rates.
6.6.14 Any request for the launch or recovery of boats shall be made at least 24 hours in advance. Late requests will only be entertained at the discretion of the Marine Department.
6.6.15 The launching and recovery of boats rests solely at the discretion of the Marina Manager / Dockmaster. Refusal to launch or recover a boat will be based firstly on safety considerations and may be exercised in cases of inadequate documentation or the failure of a Member to settle his account.
   
6.7 BOATS OF LENGTH 8.5 AND ABOVE
6.7.1 Land storage is permitted provided storage space is available.
6.7.2 Terms and conditions are as per boats under bylaw 6.6. However, applications will be considered on a case-by-case basis jointly by the General Manager and Marina Manager / Dockmaster.
6.7.3 Acceptance or rejection of applications will be based on a number of factors, paramount of which will be safety considerations. Other factors that will be considered will be the weight of the boat, possible obstruction and the design of the boat.
6.7.4 Upon acceptance of the application, a Member will be required to sign RSYC's berthing license agreement.
   
6.8 BOATS WITH HEAVIER DISPLACEMENTS
6.8.1 Such boats may only be recovered for minor maintenance and repair purposes for a short period of time and provided this can be done safely.
6.8.2 Application should be submitted to the Marina Manager / Dockmaster and will be considered on a case-by-case basis jointly by the General Manager and Marina Manager / Dockmaster. The key consideration will be the safety aspect and issues such as the total weight of boat and the type and condition of trailer provided by the boat Owner will be taken into account in making a decision.
   
6.9 NUMBER OF BOATS PER MEMBER
6.9.1 A maximum of two boats per Member may be allowed at any one time in designated locations on land and approval is on a first-come-first-served basis with the exception of emergency cases.
   
6.10 FUELLING
6.10.1 With regard to boats kept in Dry Storage, requests for fuel shall be made at the time when launching is requested.
6.10.2 A surcharge of $5/- per jerry can (irrespective of amount of fuel taken up) shall be levied by the Marine Dept. if requested to transport fuel to Members boats.
6.10.3 Members are to sign the fuel chits prior to taking their boats out. If Members decline to sign the fuel chits it will be assumed that the amount requested had been dispensed into Member's boat and the Member will be billed accordingly.

6.10.4
No power driven Vessel shall have any motor running while refueling at the fuelling point or anywhere in the Premises.
6.10.5 No petrol, oil or other flammable liquid, or any petrol, oil or similar soaked material of any description shall be discharged or thrown into the water from any Vessel in the Marina.
6.10.6 No Vessel shall be left unattended with its engine running while in the Marina.
   
6.11 DISPOSAL OF BOATS
6.11.1 The RSYC shall be entitled, at its absolute discretion, to remove, scrap, sell or otherwise dispose of any boat, trailer or equipment of a Member that has been neglected, is derelict, has sunk, or is in an unsafe condition or is owned by a Member in arrears of charges and dues or, if the boat is abandoned after a person has ceased to be a Member of the RSYC.
6.11.2 The boat Owner shall be liable to pay, or indemnify the RSYC against any and all dues, fines, penalties, or other expenses incurred by the RSYC, or occasioned by the removal and disposal of the boat, trailer or equipment.
6.11.3 PROCEDURE FOR THE DISPOSAL OF BOATS
 
6.11.3.1 Prior notice of the intended disposal shall be given to the Owner of the boat by means of a registered letter to his last known address as given to the RSYC.
6.11.3.2 Photographic evidence of the boat shall be taken prior to the disposal.
6.11.3.3 Permission shall be sought from the MPA to break up the boat if it is un-seaworthy.
6.11.3.4 On approval from the MPA the boat will be broken up and photographs taken of the results.
6.11.3.5 If the boat is of some value it may be auctioned and the proceeds of sale shall be used to set off against any costs incurred by the RSYC and towards payment of any monies owing by the Member to the RSYC.
   
6.12 CORPORATE BOATS
6.12.1 All corporate boats must be registered in the Corporate Member's name unless an indemnity satisfactory to the Club is provided. The Corporation may nominate a maximum of two nominees from the Company to be responsible for the use and maintenance of the boat.
 
6.13 BOAT OWNERSHIP
6.13.1 Only Members may be Owners and co-Owners of boats registered at the RSYC.
6.13.2 When Ownership of a boat is transferred to a non-RSYC Member, the following procedures shall prevail:
 
6.13.2.1 The new Owner is given 30 days from the date of change of Ownership to apply for Membership at the RSYC and to submit the required Entrance fee. Alternatively, he may remove the boat from the RSYC Premises after settling any outstanding charges to the RSYC in respect of the boat.
6.13.2.2 He shall be required to pay immediately the visitor fees for use of the RSYC facilities, i.e. the monthly dues as well as the mooring fees and other charges as may be necessary, during the 30-day period.
6.13.2.3 Should the new boat-Owner's application for Membership not be accepted, he shall be required to remove the boat immediately from the RSYC Premises.
   
6.14 BOATS REGISTERED UNDER SZH/SC
6.14.1 Boats licensed under SZH/SC must obtain special permission for mooring at RSYC from the General Manager.
6.14.2 All SZH/SC boats registered at the RSYC must be owned by Members and must meet all MPA regulations.
6.14.3 A Member who is the Owner of a SZH/SC boat shall be responsible for the proper conduct of his passengers. Additional fees may be applied for non-Member use of the facilities.
6.14.4 The RSYC Committee has the right to refuse entry to any passenger without assigning any reasons.
   
6.15 REPAIRS AND MAINTENANCE
6.15.1 No work shall be done to any Vessel whilst at the Club's Premises except with the prior written consent of the Club, other than minor running repairs or minor maintenance of a routine nature not causing any nuisance or annoyance to any other users of the Club's Premises or any other person residing in the vicinity.
6.15.2 Prior written consent for work to be carried out in the Club's Marina or Premises or moorings shall not without good cause be withheld provided the Club has set aside an area where Owners may carry out work on their Vessels and the work for which consent is sought is restricted to that area and is not to be carried out in a manner prohibited under regulations for the time being made by the Club with regard thereto.
 
6.16 PRIVATELY EMPLOYED PERSONNEL
6.16.1 BOATMAN / CREW
 
6.16.1.1 A Member who so employs a boatman/crew at the RSYC shall not only be responsible for ensuring the boatman/crew fully understands such applicable Constitution and Bylaws with which he is required to comply, but shall be held fully responsible for any acts or omissions of his boatman/crew at the RSYC.
   
6.16.2 CONTRACTORS AND CASUAL WORKMEN
 
6.16.2.1 Contractors and Casual Workman must report to the Security Office and obtain a "Contractors Pass". Workers are not permitted to enter the RSYC without prior approval of the General Manager or Marina Manager / Dockmaster.
6.16.2.2 A Member may request the RSYC to admit specifically identified workmen for a limited defined period in such a manner to enable proper identification and control of such entry including any vehicle.
6.16.2.3 Any Member who causes and/or authorises any workman or vehicle to enter the RSYC shall be responsible for the acts and omissions of such workman.
